State Senate votes to repeal 1913 law

The Massachusetts Senate voted Tuesday to repeal the 1913 law that prohibits gay couples that are out-of-state residents from being married in the Bay State, the Associated Press reports.

Under the law, gay couples cannot wed in Massachusetts if their state of residence does not recognize gay marriage. After Massachusetts legalized same-sex marriage in 2004, then Gov. Mitt Romney (R) invoked the obscure law to keep gay couples from coming to the Bay State to wed.

State House Speaker Salvatore Dimasi (D-Boston), Senate President Therese Murray (D-Plymouth) and Gov. Deval Patrick (D-Milton) have all said they support repealing the law. The House is expected to vote on the measure this week.
