Resignation has nothing to do with case, says Marzilli’s lawyer

UPDATED: Jim Marzilli's lawyer said Monday that the embattled state senator's resignation on Friday was completely independent from and will have no bearing on his legal proceedings.

"His resignation has nothing to do with legal case," Terrence Kennedy, Marzilli's lawyer, told PolitickerMA.com. "One has nothing to do with the other at all."

Marzilli, an Arlington Democrat, currently faces multiple counts of sexual harassment. His resignation on Friday came on the heels of details of an October trip to Berlin, Germany, for an environmental forum emerging.

Kennedy said that Middlesex District Attorney Gerard Leone won't be any more lenient toward Marzilli in light of the resignation. "You don't now Gerry Leone very well," Kennedy said, "Gerry Leone is a very hardnosed prosecutor who couldn't care less whether he resigned."

Kennedy also scoffed at any indication that a deal was made that would benefit Marzilli if he resigned.  "Not only was that not the case," Kennedy said. "I have never had any discussion about that whatsoever."

Leone did not return calls for comment. When he does, they will appear on PolitickerMA.com.

Kennedy also said that he did not contribute to Marzilli's deliberations before resigning.

"That was his own decision," Kennedy said. "He advised me of his intention to resign hours before it happened."

UPDATE, Monday, 4:15 P.M.: Corey Welford, a spokesman for Leone, echoed Kennedy's sentiments.

"The resignation will have absolutely no impact on our criminal case," he said.
