Governor's Councilor Kelly Timilty reached an agreement with Attorney General Martha Coakley Monday to pay $8,000 for distributing a mailer featuring an endorsement from Gov. Deval Patrick that she never received, according to the attorney general's office.

Timilty must also adhere to strict protocols with regards to using endorsements in her future campaigns.

Timilty, a Dedham Democrat, distributed a mailer that featured Patrick's endorsement during her primary race this year against Robert Jubinville. Sources close the governor said then that Patrick did not endorse Timilty.

Coakley's office confirmed that report and said that Timilty has agreed to have her campaign committee pay a $8,000 civil penalty, eight times the maximum financial penalty that could be imposed after a criminal conviction of falsely claiming an endorsement. As part of the agreement, Timilty must obtain an endorsement in writing before using it in future campaign materials. She will also be required to submit a protocol to Coakley's office and the Office of Campaign and Political Finance for how she will obtain written consent from endorsers.

"Our state election laws exist to guarantee the integrity of the democratic process," Coakley, a Medford Demcorat, said in a statement. "When a campaign claims to have an endorsement without having the express consent of the alleged endorser, the campaign violates the law and creates a risk of misleading voters.  We appreciate the cooperation of Councilor Timilty and her campaign committee to accept responsibility for this matter and address it in a productive way."
