Timilty agrees to pay $8,000 for false Patrick endorsement claim

Governor's Councilor Kelly Timilty reached an agreement with Attorney General Martha Coakley Monday to pay $8,000 for distributing a mailer featuring an endorsement from Gov. Deval Patrick that she never received, according to the attorney general's office.

Timilty must also adhere to strict protocols with regards to using endorsements in her future campaigns.

Governor's Councilor Kelly Timilty apologized to Gov. Deval Patrick for using a forged endorsement in a campaign mailing Wednesday, the Boston Globe reports.

Timilty's camp also maintained, however, that it believed it had Patrick's endorsement.

What Timilty's lawyer should be reading

If Deval Patrick wants to seek legal action against Kelly Timilty for inappropriately using his name and endorsement on a campaign mailing, he may be able to under Massachusetts state law.

Patrick (D-Milton) may be able to take action against the 2nd District Governor's Councilor under Section 41A of Chapter 56 of Massachusetts State Law, which details election laws.

Despite phony mailer, Timilty wins

Kelly Timilty held on to her 2nd District Governor's Council seat Tuesday, despite news breaking late in the day that her campaign distributed a flyer featuring a forged endorsement from Gov. Deval Patrick.

Timilty, a Dedham Democrat, held off primary challenger Robert Jubinville, of Milton, by 32 percent. The final tally showed Timilty receiving 66 percent of the vote and Jubinville earning 34 percent.

Timilty's brother: The Gov. ‘fully endorsed' her

According to her brother, Governor's Councilor Kelly Timilty was "fully endorsed" by Gov. Deval Patrick.

Greg Timilty told the State House News Service Thursday that he knew his sister's campaign was planning on sending a mailer displaying Patrick's endorsement.

"No mix-up, it was pretty clear," he told the State House News. "I was under the assumption he was fully aware that he was endorsing."
