Gutierrez pleads not guilty

The central figure in the scandal that drove former Attorney General Marc Dann from office last year pleaded not guilty this morning to 10 criminal charges against him.

Anthony Gutierrez, who was Dann's general-services director, is the first player in the Dann administration to face criminal charges stemming from the Democrat's 17 months in office.

Franklin County Prosecutor Ron O'Brien's office accuses Gutierrez of using state computers and time to file phony statements to the Ohio Bureau of Workers Compensation for his private construction business. Gutierrez also is accused of using Dann's campaign account to cover living expenses at a Dublin-area condo he shared with Dann and the former attorney general's spokesman.

Anthony Gutierrez Indicted On 10 Charges

Proving that the Marc Dann saga will probably never truly be over, Dann’s former aide and the main antagonist of the whole story, Anthony Gutierrez, was indicted on 10 counts today by a Franklin County Grand Jury.

The counts are:

  • One Count – Theft in office (felony)
  • Two Counts – Unauthorized use of property (felony)
  • Three Counts – Workers compensation fraud (felony)
  • Two Counts – Soliciting or receiving improper compensation (misdemeanor)
  • One Count – Improper election activity (misdemeanor)
  • One Count – Filing a false statement (misdemeanor)

Considering Dann was in office for little more than a year, that’s quite a list. Considering Franklin County Prosecutor Ron O'Brien’s GOP partisan hack status, I wouldn’t be counting on any mercy for Gutierrez.

Marc Dann fined for campaign violations

The commission decision was based on findings by Secretary of State Jennifer Brunner, who referred Dann to the commission, concluding he improperly spent $40,610 in campaign money on home security upgrades and $4,369 on cell phone bills for his family.

But the commission declined to refer the matter to a prosecutor, instead imposing a maximum $1,000 fine for the security system violation. Dann was publicly reprimanded for the cell phone violation.

The panel also found campaign assistant Mary Beth Snyder guilty of a violation because she signed the checks for the security system and fined her $250.

Dann, who attended today's commission hearing, had contested the complaint, saying that the home security system was a legitimate campaign expense because death threats had been made against him and his family after he took office.

Marc Dann Found In Violation Over Spending

Marc Kovac is reporting on Twitter that Marc Dann has been found in violation over spending state money on cell phone bills and security upgrades to his house.

Update: Commission chooses not to fine or recommend prosecution over cell phone violation, just a public reprimand. Dann was fined $1,000 for his home security spending.

State Elections Commission plans hearing on Dann today

COLUMBUS -- Former Ohio Attorney General Marc Dann is ready to respond to allegations
that he misused campaign contributions for trips, family gifts, and everyday expenses such as
coffee, meals and newspapers.

The Ohio Elections Commission has scheduled a hearing today on two sets of accusations.

An investigation by Inspector General Tom Charles concluded that Dann filed inaccurate and false
information about his expenditures.

In a separate complaint, State Jennifer Brunner accuses Dann of misspending about $45,000
in campaign funds on security improvements at his home and for cell phone bills.

Dann, who plans to attend the hearing, has denied the allegations in a 40-page motion to dismiss
the case.

The Democrat resigned last May over a sexual harassment scandal involving a top aide.

Goodbye and good luck

I'm outta here.

I don't mind people who disagree with me.  In fact, I came here because I enjoy the give and take of a good debate.  Lord knows, I suffered the slings of arrows of several frontpagers, commenters, and other bloggers because of my support of Hillary Clinton.  And yet, despite some deeply personal and regretable attacks from both sides, I stayed.

I've been at this site for three years now.  I've gone through three rounds of site administrators during that time.  I think it's safe to say I'm the longest running member of BSB still blogging. Until today.  Because during my entire time at BSB, I've had one simple request for the administrators here: we don't have to agree with each other, but we should always have each other's back.

State to see whether Dann, aide can be held liable

Democrat Richard Cordray said his office is looking into whether Dann and Gutierrez can be held personally liable for some of their behavior as state officials in 2007 and early 2008. Gutierrez was fired in May 2008, about two weeks before Dann resigned under pressure.

The office also is looking into whether part of its legal settlement with two ex-employees could be paid by a bond that Dann submitted upon taking office or other bond funds that generally cover state employees, Cordray said.

Cordray made his comments as a panel of legislators approved the $495,000 in payments to Cindy Stankoski and Vanessa Stout, who were regularly subjected to crude sexual comments and advances from their boss, Gutierrez, in late 2007 and early 2008.

The Preamble of the Ohio Democratic Party's Constitution and Bylaws of 2007 states, that our party is organized to "sustain and advance the principles of democracy" and that one of the essential tenets of our party is that "We believe that there is no substitute for fair and equal representation and strong public participation in a government chose by election."

And yet, despite that being one of the fundamental principles of the Ohio Democratic Party, Chapter 9 of that same documents says:

"In any election year in which any statewide office . . . are to appear on the ballot, the Executive Committee shall be called for a meeting before the primary election and must carefully consider in each race the endorsement of one of more persons.

Senate Minority Whip Ray Miller about to be "whipped" by the Ohio Elections Commission

Secretary of State Jennifer Brunner's office today filed a complaint with the Ohio Elections Commission accusing the Columbus Democrat of violating three campaign finance laws: failing to file a full, true itemized statement; failing to keep a strict and accurate account; and failure to correct inaccurate reports.
