Kids, grownups can't get online cigarettes shipped to them

Senate Bill 5340, which was requested by state Attorney General Rob McKenna, is intended to stop teenagers from buying cigarettes, chewing tobacco and snuff online. It also is aimed at the teenagers' moms and dads who buy tobacco products on line and get them shipped to them and don't pay taxes on them.

SB 5340, which was passed by the Senate Thursday night on a 47-0 vote, says that tobacco products purchased online must be shipped to a retailer or wholesaler, not to homes.

Violations carry a possible 5-year prison sentence and $5,000 fine, although more than likely McKenna would use the $5,000 civil fine provision.

Should prisoner access to public records be limited?

There's a public records debate going on in Olympia that raises some interesting questions about the limits of open government.

State Attorney General Rob McKenna, who's built a reputation as a defender of open government, is asking for an exception to the public disclosure law when handling requests from inmates. He says a handful of inmates are abusing the law and wasting money and "terrorizing" with frivolous records requests. "Prison inmates developed a cottage industry, filing multiple, complicated Public Records Act requests with the hope state government will make a mistake so they can sue for a windfall," he wrote. "This abuse threatens timely access to government information for all legitimate requestors and devours tax dollars in the process.

Ladenburg interested in EPA post

Pierce County Executive John Ladenburg (D-Tacoma), who was the Democratic nominee for attorney general in 2008, is very interested in becoming the Environmental Protection Agency administrator for Region 10, a source close to Ladenburg tells PolitickerWA.com.

Region 10 covers Washington, Oregon, Idaho, Alaska and Pacific Northwest Indian Country. Oregon's Elin D. Miller currently holds the post after being appointed in late 2006.

UPDATED: Poll shows tight races for OSPI, lands commissioner

A recent poll from SurveyUSA shows close margins in the statewide races for superintendent of public instruction and commissioner of public lands, but clear leaders on two ballot initiatives and in the race for attorney general.

Incumbent Commissioner of Public Lands Doug Sutherland (R-Tacoma) leads Okanogan Democrat Peter Goldmark 45-43, and challenger Randy Dorn is ahead of incumbent Terry Bergeson 43-38 in the race for superintendent.

Elway Poll statewide snapshots

The latest Elway Poll, in addition to the gubernatorial race, also took the pulse of each of the other state wide elections.

In the race for attorney general, incumbent Republican Rob McKenna extended his lead over Democrat John Ladenburg by six points from September. He now leads 48 to 29. Remarkably only 55 percent of Democrats were supporting Ladenburg.

The battle for public lands commissioner remains close, with incumbent Doug Sutherland (R-Tacoma) regaining the lead from Peter Goldmark (D-Omak) 37-33, with 30 percent still undecided.
