New York Times puts Chris Gregoire on Supreme Court list

In its story on the possible retirement of David Souter from the U.S. Supreme Court, the New York Times ventures into heavy speculation on President Obama's first appointment.

No sources are listed but the reporters suggest that since Obama once praised former California Gov. Earl Warren's service on the Supreme Court that he might be looking at a politician rather than a legal expert.

"During the campaign, Mr. Obama spoke of his admiration of former Chief Justice Earl M. Warren, citing as a special virtue his practical political experience as a former governor of California. If Mr. Obama were to look to a political figure with a strong legal background, he could turn to an old friend, Deval Patrick, now the Massachusetts governor, Christine Gregoire, governor of Washington, or Jennifer M. Granholm, governor of Michigan."

Let the speculation begin.

Legacy Project honors first woman Supreme Court justice

OLYMPIA – Before Sandra Day O’Connor was appointed to the U.S. Supreme Court 28 years ago, Carolyn Dimmick was already getting used to breaking the glass ceiling in the judiciary in this Washington.

As the state and nation commemorate Women’s History Month, Dimmick, the first woman justice on the state Supreme Court, is being honored with a new oral history and profile.

West Virginia case could have implications in our judge elections

The U.S. Supreme Court will hear oral arguments Tuesday in a case that could change how Washington elects judges – especially those for the state supreme court.

The case – Caperton v. Massey – is summarized in this Washington Post article. It involves the owner of a big coal mine in West Virginia who was sued by the owner of a small coal mine for driving him out of business. The little guy won initially but lost in a narrow state supreme court ruling.

In between the lower-court ruling and the supreme court ruling, however, was a campaign that saw an incumbent defeated with the help of $3 million from the owner of the big coal mine.

No "separate but equal" for marriage equality

It has been over 50 years since the U.S. Supreme Court struck down racist laws that consigned African American children to attending separate, but supposedly equal, schools.

The court's ruling held, essentially, that the underlying notion of "separate but equal" school facilities was itself unconstitutional.

Today no one questions that decision, and no one would (at least not publically) suggest that we ought to go back to the segregated world of the 1940s and before.

Yet, many of the same people who understand that it is wrong to give children different educational experiences because of the color of their skin, still hold that it is acceptable to give couples in committed, loving relationships different legal rights on the basis of the shape of their genitalia.

UPDATED: McKenna underscores importance of McCain success in Washington for judges, Rossi

MINNEAPOLIS - Washington State Attorney General Rob McKenna spoke at the Republican delegation breakfast this morning and gave an address focusing on the need to elect presumptive Republican presidential nominee Sen. John McCain on the grounds that the next president will likely be able to select at least one Supreme Court justice.

"Don't you just love events that are emceed by Ralph Munro?" McKenna asked the crowd to start his speech, referring to the former Secretary of State who has been running the delegate meetings every day with humor and good spirit.
